Patent
Patent is any new invention or discovery in various fields of industry or agriculture that will give exclusive right to the inventor ordiscoverer to benefit from his patent. Under following Claims, any person can apply for a patent. – New innovation in a newindustrial product – Discovery of a new means or the discovery of a new method using existing ones to obtain a different result orproduct in industry & agriculture .
Filing:
Requirements for filing patent application are as follows: · A power of attorney duly certified and legalized up to the IranianConsulate. · A certified copy of Home application/registration duly legalized up to Iranian Consulate (if any). · Full name, addressand nationality of the applicant(s). · Title of Invention · One set of the formal drawings relating to the invention (if any).
Types of patents:
- Patent of Convention
- Patent of Importation
- Patent of Independent
Patent of Convention:
Patent of convention is based on a foreign priority and is valid for a period of twenty years from the Iranian filing date. This type ofpatent must be filed within the twelve months from the original filing date. The life of the patent is for twenty years and annuity mustbe paid each year on the anniversary of the Iranian filing date. For this type of patent only the claims and few pages of certifiedcopy of priority document requires translation.
Patent of Importation:
Patent of importation is based on a foreign granted patent and is valid for the remaining life of the foreign patent. Annuity must bepaid each year on the anniversary of the Iranian filing date. For this type of patent only the claims and few pages of patentcertificate requires translation.
Patent of Independent:
Patent of independent is a patent that is not based on any foreign registration or application, and will be filed in Iran without anypriority. The life of the patent is twenty years from filing date in Iran. For this type of patent specifications and claims must betranslated into Persian.
Patent Annuity:
All or part of annuity fee can be paid for a patent. The annuity can be paid each year on or before the anniversary date of filing.
Changes:
All changes and modifications should be registered and recorded officially.
Late filing of Documents:
According to Iran patent Law, the required documents can be filed late. Foreign Applicants should submit the necessary documentsto Iran Patent office within 6 months after filing date, of course this time can be renewed for second 6 months.
